Scheduling Terms and Conditions

THIS AGREEMENT is entered into by and between All Out K9 and dog owner. Owner is represented as the person named, first and last, as the responsible party on the new visitor and/or training interest form when requesting services for the dog.

1) I (Owner) represent that I am the legal owner of the dog(s) I've scheduled for care and services with All Out K9 and I assume all risks, dangers, and responsibility for injuries to the named dog(s). Owner understands and agrees that Owner is solely responsible for any harm while Owner’s dog(s) is/are attending Daycare / Boarding.

 

2) PHOTO AND VIDEO RELEASE: We love to post pictures and videos on Instagram and our website. Owner agrees to allow All Out K9 to use Owner’s pet’s name and any images or likeness of Owner’s pet taken while he/she is in All Out K9's care, in any form, for use at any time, in any media, marketing, advertising, illustration, trade or promotional materials without compensation, and Owner releases to All Out K9 all rights that Owner may possess or claim to such image, likeness, recording, etc. The capture, social media posting, and text delivery of photos are done at the convenience of All Out K9 and are not guaranteed.

 

3) DOG’S HEALTH: Owner further understands and agrees that Owner’s dog(s) are healthy and will at all times while attending All Out K9 have current vaccinations for rabies, distemper, and Bordetella. Should the dog not have updated shots, the Owner must inform All Out K9 and the dogs will be cared for in a separate area. Owner is not enrolling any dog that has any condition that could potentially jeopardize the health of other dogs or people and has not had any potentially communicable condition within 30 days prior to enrollment. Owner further understands that even if Owner(s) dog is vaccinated for Bordetella (Kennel Cough) there is a chance that the Owner’s dog can still contract Kennel Cough. Owner agrees that Owner will not hold All Out K9 responsible if Owner’s dog(s) contracts Kennel Cough or other communicable ailments.

4) FLEA/TICK/LICE FREE: All dogs must be flea/tick/lice-free. Should a dog be observed to have fleas/ticks/lice, Owner will be notified and an agreed-upon resolution will be carried out. This may include a flea/tick/lice bath treatment applied while in our care and charged to the owner or the Owner picking up the dog for treatment elsewhere before returning to All Out K9 for services. Should a dog be observed to have fleas/ticks/lice while in our care, they will not be permitted to return to ALL OUT K9 until a note from a reputable, licensed veterinarian is provided stating the dog is free and clear of fleas/ticks/lice, has completed all recommended treatments and is safety able to return to a daycare setting without the possibility of passing on said fleas/ticks/lice to other dogs.

5) SOCIALIZATION: Owners who request their dog be socialized with another dog-friendly pup should indicate the appropriate dog-friendly temperament on the dog's intake questionnaire. No dog may be allowed to play with another dog who shows any signs of aggression. Owner further understands and agrees that in requesting Owner’s dog(s) participate in dog-friendly play, Owner is representing to All Out K9 that Owner’s dog(s) is/are in good health and have not harmed, shown aggression, or exhibited any threatening behavior towards any person or other dogs. All Out K9 has the right to restrict the social activity of a dog due to the dog's temperament. Socialization at All Out K9 is not guaranteed. 

 

6) RELEASE OF LIABILITY: Owner understands and agrees that during normal dog play, Owner’s dog may sustain injuries. Dog play is monitored by the All Out K9 family to best avoid injury, but scratches and other injuries may occur despite the best supervision. Owner further understands and agrees that the AOK9 family nor any of its employees, staff, or volunteers will be liable for any illness, injury, death, and/or escape of Owner’s dog(s) and acknowledges that reasonable care and precautions are followed. Owner hereby releases All Out K9 family, owners, staff or volunteers of any liability of any kind whatsoever arising from or as a result of Owner’s dog(s) attending All Out K9.

 

7) PERSONAL PROPERTY: Owner understands that Owner is solely responsible for any harm, including to any other pet(s), to the employees or invitees of All Out K9, or to the equipment, facilities, or other property of All Out K9, caused by Owners dog(s). Owner also agrees that All Out K9 shall not be responsible or liable for any lost or damaged personal property belonging either to Owner or Owner’s pet.

 

8) FOOD/MEDS: Owner agrees that it is the Owner’s responsibility to pack and send an adequate supply of food and medications for Owner’s dog(s) during the entire time Owner’s dog is cared for by All Out K9. Should the food/medication supply need replacement, Owner authorizes All Out K9 to purchase replacement and Owner will reimburse All Out K9 for the actual food and medication costs.

9) VETERINARIAN LIABILITY AND CARE: Owner agrees to allow All Out K9 to obtain medical treatment for Owner’s dog(s) if he/she appears ill, injured, or exhibits any other behavior that would reasonably suggest that dog(s) may need medical treatment including anesthesia. Owner agrees to be fully responsible for the cost of any such medical treatment and for the cost of any transportation for the purposes of such treatment. Owner gives permission to All Out K9 to use Owner’s vet, All Out K9's vet or nearest 24-hour vet hospital for any required treatment.

10) WEAKENED IMMUNE SYSTEM: Owner understands special-needs dogs, young puppies, and senior dogs naturally have a higher risk of injury, stress-related illnesses, weakened immune system, or exacerbation of any pre-existing condition. As such, by using AOK9 services the Owner is waiving any claim for injury or illness experienced by Owner’s dog while in our care.

11) ELDERLY DOGS: Owners of elderly dogs (approaching the end of life) need to know if in the event Owner’s dog passes on while in our care, our policy is to contact the Owner and give the owner the option of picking up the dog or having us transport Owner’s dog to Owner’s vet where he/she will be held until Owner can get to the vet for further instructions. If Owner’s vet is closed, then we can transport to the nearest 24-hour facility.

12) PREPAID SERVICES: Owner understands that prepaid boarding, training and nutritional services are non-refundable and a credit will be issued in the amount paid for future services. Owner understands that prepaid ranch camp visits are nonrefundable but if cancellation is necesssary, payment will be converted to a donation to Misfit Ranch Rescue and a donation receipt will be issued.

13) CANCELLATION / NO-SHOW POLICY: Cancellations must be done 24-hours prior to the reservation date. For any cancellations where the service has been paid in full at the time of scheduling, a credit will be issued to be used another time. Door cancellations and no-shows will require payment for services at the time of scheduling for future reservations.

14) TRAINING: Owner acknowledges All Out K9's training terms and conditions.

15) BUSINESS HOURS AND SCHEDULING: Owner acknowledges that the AOK9 phone is reserved for scheduling purposes only and is only checked once daily, on most days of the week. It can take 72 hours or longer to receive a response to a message sent to the AOK9 phone number. Owner will receive an alternative phone number that can be used to check in our Owner's dog(s) during a visit. Owner acknowledges that while they are able to check in on their dog at any time, it can take 24 hours to receive a response. Owner acknowledges that a 3-5 hour window will be provided as AOK9's expected time of arrival for both pick-ups and drop-offs. If Owner is not available to transfer the care of the dog during the agreed upon time, AOK9 may have to cancel services due to the client's "no-show" and pre-okay for services may be required for future scheduling. Alternatively, Owner acknowledges that if their dog has had at least one previous visit and AOK9 makes the offer, AOK9 may still be able to pick up or return the dog home with a provided spare key or door code. Owner agrees that if they are not available at the scheduled meetup time to transfer the care of Owner's dog, the Owner hereby authorizes overnight boarding until AOK9 has an opening in the transportation schedule to return to the home and agrees to pay All Out K9 for applicable overnight boarding charge plus any charge for required food, until the transfer of care can be completed.

 

16) RIGHT OF REFUSAL: All Out K9 reserves the right to refuse admittance to any dog and service to any Owner. The determination shall be made at the sole discretion of All Out K9.

17) ENVIRONMENTAL: The Owner acknowledges that All Out K9 operates on a private, off-grid 50-acre ranch where dogs participate in activities within a natural, rural environment. While All Out K9 exercises reasonable care at all times, provides continuous supervision during activities, and implements extensive preventative measures to minimize risks, the Owner understands that exposure to naturally occurring environmental hazards cannot be completely eliminated.

Such hazards may include, but are not limited to, insects, spiders, scorpions, snakes, wildlife, uneven terrain, native vegetation, foxtails, cacti, and other naturally occurring conditions commonly found in a rural desert environment. By utilizing All Out K9's services, the Owner voluntarily assumes these inherent risks and agrees that All Out K9, its owners, employees, volunteers, agents, and affiliates shall not be held liable for injuries, illness, or damages resulting from exposure to or encounters with naturally occurring environmental hazards.  In the event a dog is injured or requires veterinary treatment due to an environmental hazard or other emergency, the Owner authorizes All Out K9 to seek appropriate veterinary care in accordance with the medical authorization provisions of this Agreement, with all associated expenses remaining the responsibility of the Owner.

18) Tracking devices and collars, such as Airtags/SmartTags/Tile/Fi, etc., are strictly prohibited to protect the privacy and safety of our clients. We have working dogs in our care 7 days a week and contracts with members of the government and law enforcement that prohibit the tracking to/from their residence and location of their dogs. Sending a tracking device with your dog's things puts us in direct violation of our contracts and puts the privacy and safety of AOK9 clients in jeopardy. Should a tracking device be discovered in your pup's things once they are in our care, the device will be immediately disposed of and based on the nature of discovery, could prevent AOK9 from offering services to you and your pup in the future. Should you send a tracking device with your dog that is not caught and left with you during pickup, you will be willfully surrendering the device for disposal. AOK9 is not responsible for the reimbursement or replacement of the tracking device.

19) AOK9 Fee Schedule

20) FULL FORCE AND EFFECT: Owner further understands and expressly agrees that each and every of the foregoing provisions contained in paragraphs 1-19 shall be in force and effect and shall apply to each and every occasion on which Owner’s dog(s) stays with All Out K9 for ranch camp, boarding, training, or other services, as the case may be. This Agreement shall remain in full force and effect as between the parties until and unless otherwise canceled or superseded by a writing signed by the parties. Owner hereby certifies that by scheduling services with All Out K9, Owner has read and understands this Waiver and Release of Liability and the regulations set forth above.
