Training Program Terms and Conditions

THIS AGREEMENT is entered into by and between All Out K9 and the dog owner. The Owner is represented as the person named, first and last, as the responsible party on the new visitor and/or training interest form when requesting services.

1) I (Owner) represent that I am the legal owner of the dog(s) I've scheduled for services with All Out K9 and I assume all risks, dangers, and responsibility for injuries to the named dog(s). Owner understands and agrees that Owner is solely responsible for any harm while Owner’s dog(s) is attending the All Out K9 training program.

 

2) PHOTO AND VIDEO RELEASE: All Out K9 may post pictures and videos on Instagram and their website. Owner agrees to allow All Out K9 to use Owner’s pet’s name and any images or likeness of Owner’s pet taken while he/she is in All Out K9's care, in any form, for use at any time, in any media, marketing, advertising, illustration, trade or promotional materials without compensation, and Owner releases to All Out K9 all rights that Owner may possess or claim to such image, likeness, recording, etc. The capture, social media posting, and text delivery of photos are done at the convenience of All Out K9 and are not guaranteed.

3) CONSULTATION:  All training consultations are done in-home to discuss the Owner's training goals and concerns, the All Out K9 training programs, pricing, and more.

4) EVALUATION: Owner acknowledges that a training consultation/evaluation must be scheduled prior to any official training services being added to our calendar so that the All Out K9 team can determine the best training program for the dog, based on the observed temperament, skill level, and interaction with the All Out K9 family. Training consultation fees are due at the time of scheduling and are nonrefundable. Should the Owner find the need to skip evaluation and immediately schedule a board and train pickup due to scheduling or other emergent concerns, the Owner acknowledges and accepts that an evaluation will take place within 5 days of the transfer of care to All Out K9, and prior to the commencement of any training. Forfeiting the evaluation for the Owner's scheduling or other needs may result in a longer stay for the dog with All Out K9 to complete the training program or the transfer of care to a training colleague of All Out K9 is not the best-suited trainer for the dog. Owner understands and agrees that the transfer of a dog to an All Out K9 colleague may result in additional fees.

5) DEPOSIT: A nonrefundable deposit is required to schedule All Out K9 board and train programs. Session training fees are due in full by 8pm the veening before the scheduled session to confirm the appointment for the following day.

6) TRAINING DURATION: Owner understands and agrees that the length of training required, and what can be accomplished, is entirely dependant on the dog’s prior experience, living environment, temperament, and capacity to learn. Owner also understands and acknowledges that basic training generally requires a four-week stay for confident dogs who are ready to learn but may take longer in some cases and for some breeds. The training program will begin the first calendar day after the dog's scheduled pickup. Once the training program has been completed, the Owner will be contacted to schedule the transfer of care back to the Owner.

7) TRAINING PROGRAM: The skills worked on with All Out K9's board and train program include Sit on verbal and signal, Down on verbal and signal, Sit-Stay, Come when called, Leave It, Loose-Leash Walking and eCollar response training. Once basic skills are in place, the Trainer(s) will work to incorporate these skills into real-life scenarios, such as: Sit-stay as a door is opened; Leave It while passing another dog or people. Trainer(s) may take the dog to locations, such as parks or stores, as appropriate to achieve training goals. Once basic training goals have been completed, the trainer(s) will move on to skills such as social manners, place commands, off-leash training, down-stay, and more, if time allows. If the standard board and train program for basic obedience was completed but was not adequate to ensure off-leash reliability for the dog and the trainer believes it can be achieved, the dog can return for a two-week off-leash training program or private training sessions for an additional fee.

8) COMMUNICATION: Owner acknowledges that dog training is a process. There may be long periods of time without an update from the trainer while they are working with the dog to acheive training goals. The trainer will update when needed/necessary. Owner acknowledges that scheduled updates are not guaranteed. Owner is able to text or call at any time to inquire about the dog. The trainer's response time may vary depending on the schedule and response times are not guaranteed.

9) ENRICHMENT: All Out K9 includes a variety of enrichment activities during the training program, such as daily one-on-play sessions, group play for dog-friendly dogs, walks, hikes, tug and more. 

10) K9 CARE: During the All Out Training Program, dogs will be fed the food supplied by the Owner in the amount specified when they first arrive. The Owner acknowledges and agrees that the amount of food per feeding may need be adjusted throughout the training program based on the dog's needs due to fluctuating activity levels. Treats will only be provided when earned once training has begun. Basic bathing services, such as shampoo and brushing, will be provided by All Out K9. 

11) SOCIALIZATION: No dog may be allowed to free-play with another dog who shows any signs of aggression. All Out K9 has the right to restrict the social activity of a dog due to the dog's temperament. Socialization at All Out K9 is not guaranteed. 

12) PAYMENT: The Owner acknowledges and agrees they were or will be, provided the cost of the All Out K9 training program during their initial training consultation via phone and that they will receive an invoice via text or email outlining the cost of the All Out K9 program. Payments can be made at any time through that invoice until it shows as paid in full. The Owner's invoice must be paid in full by the scheduled drop off and transfer of care of the dog back to the Owner. The Owner acknowledges that should they refuse to pay for their services, they will not receive the dog's training package at drop off and will be contacted by All Out K9's attorney for failure to pay and legal action. This will also result in a future refusal of service to Owner.

 

13) TRANSFER OF CARE: The Owner acknowledges and agrees that they will be contacted when the dog has completed the All Out K9 training program to discuss the skills they've achieved and any extras that were not. The Owner can opt to extend their training to acquire additional skills, such as off-leash training if it wasn't achieved or advanced social manners, should they choose to for an additional fee. If the owner would like to proceed with scheduling the dog's drop off, arrangements will be made for the next available day/ time in All Out K9's training calendar for the transfer session. Transfer sessions are usually scheduled at a park so that the obedience and skills acquired during training can be properly demonstrated outside of the dog's home environment. The Owner acknowledges that while transfer sessions average about an hour in length, they should set aside a minimum of 2 hours for this session in the event that it takes an extended period of time. At drop off, the trainer will review the training with the Owner , go over any training goals that were not met within the program and will review with the owner training to be implemented at home to maintain training goals. The Owner will be provided with the essential tools used in our training program to take home. This includes a slip-lead leash if they do not already have one, an elevated dog cot for dogs who mastered the Place Command and an eCollar package for dogs who completed eCollar response and/or off-leash training. Should the dog go home with an eCollar package, the Owner will receive in-person instruction on how to use the collar and transmitter but is responsible for reviewing the included owner's manual on their own for proper use. The Owner acknowledges and agrees that if the dog has not completed the eCollar response training and/or off-leash training, an eCollar will not be provided to the Owner for the safety of the dog.

14) MAINTENENCE: The Owner understands that the training will result in the Dog responding to the Trainer and that the Dog may not initially respond as reliably to the Owner. The Owner understands and acknowledges that they will need to work with the dog daily to build reliability and a training relationship themselves, with the guidance provided during the transfer session. The Owner understands and acknowledges that without the proper maintenance from the owner once the dog has returned home, the dog may revert to its original behavior.

To ensure Dog’s response to the Owner, the Owner agrees:

• To understand and apply the basic principles of training as described and demonstrated in the Transfer Session

• To use the cues (commands) supplied by Trainer

• To practice with the Dog daily (two, 20-minute sessions a day, 6 days a week)

• To integrate training into daily life (as described by Trainer) so as to support behavior goals (not inadvertently punishing the good behavior and rewarding the bad.)

• To follow training and management advice as given by Trainer

15) FOLLOW UP: It is the Owner's responsibility to follow up with the trainer for any guidance needed regarding skills covered in the training program once the dog has returned home. The trainer will provide assistance via text or phone for the lifetime of the dog for skills covered during the training program. If it is determined that there is a regression of training due to the owner's lack of follow through on the required training maintenance, the trainer is not liable and further assistance on the matter may be terminated at the trainer's discretion. The trainer may not be able to assist via text or phone with new issues arising after the dog has returned to the owner's care or with issues and skills not covered during the training program. The trainer may agree to work on new issues and skills for an additional fee.

 

16) RELEASE OF LIABILITY: Owner understands and agrees that during normal dog play, Owner’s dog may sustain injuries. Dog play is monitored by the All Out K9 family to best avoid injury, but scratches and other injuries may occur despite the best supervision. Owner further understands and agrees that All Out K9, staff, or volunteers will not be liable for any illness, injury, death, and/or escape of Owner’s dog(s) provided that reasonable care and precautions are followed, and Owner hereby releases All Out K9 staff or volunteers of any liability of any kind whatsoever arising from or as a result of Owner’s dog(s) attending All Out K9. Owner further agrees, understands and acknowledges that the elimination or modification of behaviors is not guaranteed. Owner acknowledges that dog training will not provide exact results as all dogs are unique and that failure to follow the professional advice given to them by AOK9 may result in an escalation of behavior and training issues. Owner further agrees to accept responsibility for any damages the dog may cause through malicious, aggressive or improper behavior that may occur before, during or after all services provided by AOK9. Furthermore, Owner understands and agrees that if their dog is injured in a dog fight or an accident, gets fleas, ticks or worms, contracts any illness or disease, is lost or stolen, becomes pregnant, or engages in any dangerous, vicious or unwanted behavior, during or after all services provided by AOK9, on or off AOK9 Premises, Owner's Home or Business or any other location, that Owner accepts the risk and agrees that AOK9 shall not be held responsible for it or any resulting injuries, losses, damages, costs or expenses.

 

17) PERSONAL PROPERTY: Owner understands that Owner is solely responsible for any harm, including to any other pet(s), to the employees or invitees of All Out K9, or to the equipment, facilities, or other property of All Out K9, caused by Owners dog(s). Owner also agrees that All Out K9 shall not be responsible or liable for any lost or damaged personal property belonging either to Owner or Owner’s pet.

 

18) FOOD/MEDS: The owner agrees that it is the Owner’s responsibility to provide an adequate supply of food and medications for the Owner’s dog(s) during the entire time Owner’s dog is cared for by All Out K9. Should the food/medication supply need replacement, the Owner authorizes All Out K9 to purchase replacement and the Owner will reimburse All Out K9 for the actual food and medication costs.

19) VETERINARIAN LIABILITY AND CARE: Owner agrees to allow All Out K9 to obtain medical treatment for Owner’s dog(s) if he/she appears ill, injured, or exhibits any other behavior that would reasonably suggest that dog(s) may need medical treatment including anesthesia. The owner agrees to be fully responsible for the cost of any such medical treatment and for the cost of any transportation for the purposes of such treatment. The owner gives permission to All Out K9 to use the Owner’s vet, All Out K9's vet, or the nearest 24-hour vet hospital for any required treatment.

20) TERMINATION: The Owner has the right to terminate the dog's training program at any time and have the dog transferred back to their care. A request to terminate the training program prior to program completion must be received in writing and needs to be sent via email to info@alloutk9.com for immediate review. Termination of the training program does not absolve the Owner of their financial responsibility, as the dog has taken the spot of another dog wishing to complete a training program, and the remaining balance of the training program will become due in full upon receipt of the request. Once paid, a transfer of care to the owner will be scheduled. The Owner acknowledges and agrees that termination of the training program prior to the completion will forfeit their right to a training collar package and other training tools commonly provided, a transfer session, follow-up session and further training assistance via phone or text. The Owner acknowledges that should they refuse to pay for the services scheduled and agreed upon, they will be contacted by All Out K9's attorney for failure to pay and legal action. This will also result in a future refusal of service to Owner.

21) General Service: Owner acknowledges All Out K9's general scheduling terms and conditions.

22) RIGHT OF REFUSAL: All Out K9 reserves the right to refuse admittance to any dog and service to any Owner. The determination shall be made at the sole discretion of All Out K9.

 

23) FULL FORCE AND EFFECT: Owner further understands and expressly agrees that each and every one of the foregoing provisions contained in paragraphs 1-22 shall be in force and effect and shall apply to each and every occasion on which Owner’s dog(s) stays with All Out K9 for daycare, boarding, or other services, as the case may be. This Agreement shall remain in full force and effect between the parties until and unless otherwise canceled or superseded by a written signed by the parties. Owner hereby certifies that by scheduling services with All Out K9, Owner has read and understands this Waiver and Release of Liability and the regulations set forth above.
